Terms & conditions of Sale

(1) Introduction
Please read these terms of sale carefully.
You will be asked to expressly agree to these terms of sale before you complete your order for products from our website.

(2) Interpretation
In these terms of sale, "we" means Buffalo Leather (and "us" and "our" will be construed accordingly); and "you" means our customer or potential customer for products (and "your" will be construed accordingly).

(3) Order process
The advertising of products on our website constitutes a contractual offer. No contract will come into force between you and we unless and until we accept your order in accordance with the procedure detailed below.
In order to enter into a contract to purchase products from us, you will need to take the following steps: a) Confirm your leather type as certain products may not be suitable for certain types of leather
b) Before purchasing products determine that you do not have a leather problem, Buffalo products improve or maintain the appearance of leather, they do not solve problems that originate from the tannery, manufacturing, or problems that contamination can cause.
c) Determine your leather colour, we cannot replicate accurate leather colours on our website due to  computer screen resolutions, we accept leather samples posted to our workshop for colour selection only, colour matching incurs an extra charge.
d) A technician is available to advise on product selection, please visit our "contact page"
Once those steps have been followed, you will need to take the following steps:

 (1) you must add any products you wish to purchase to your shopping cart, and then proceed to the checkout; (2) by signing these terms you accept the method of delivery - Buffalo dispatches your order within the UK using independent delivery companies, delivery must be accepted as 3 - 10 days from dispatch date to arrival at your given address.
Overseas destinations may take considerably longer, allowing up to 2 weeks as customs inspections delay the processing of delivery.
Orders are dispatched Mon - Fri. Bank Holidays, the Christmas period, or postal strikes may affect these delivery times. (3) You must confirm your order and your consent to these terms of sale; (4) you will be transferred to the preferred payment page, where a secure web page will handle your payment; (5) we will then send you an initial acknowledgment; and (6) once we have checked whether we are able to meet your order, we will either send you an order confirmation (at which point your order will become a binding contract) or we will confirm by email that we are unable to meet your order.
We will not file a copy of these terms of sale specifically in relation to your order. We may update the version of these terms of sale on the website from time to time, and we do not guarantee that the version you have agreed to will remain accessible. We therefore recommend that you download, print and retain a copy of these terms of sale. The only language in which we provide these terms of sale is English.
Before you place your order, you will have the opportunity of identifying whether you have made any input errors by reading through your information thoroughly by viewing your order cart. You may correct any input errors before placing your order by clicking on the relevant links (remove/change) or on screen buttons (recalculate).

(4) The products
The information provided herein is correct to the best of our knowledge. No warranty is expressed or implied as the conditions of use by you the customer are beyond our control. For health & safety information please contact us by using the information available on our "contact" page.
Buffalo products are not to be taken internally or placed in the eye or mouth area, seek medical attention should this occur. Buffalo will not be held responsible for any reactions to the skin or breathing difficulties, precautionary measures must be taken by you the customer to prevent these reactions, such as suitable protective breathing apparatus & room ventilation, and protective skin coverings.

 Prior to purchase of products from us, you will need to take the following steps:

a) Confirm your leather type as certain products may not be suitable for your type of leather
b) Before purchasing products determine that you do not have a leather problem, Buffalo products improve or maintain the appearance of leather, they do not solve problems that originate from the tannery, manufacturing or problems that contamination can cause.
c) Determine your leather colour, we cannot replicate accurate leather colours on our website due to your computer screen resolution, we accept leather samples posted to our workshop for colour selection only, colour matching incurs an extra charge.
d) A technician is available to advise on product selection, please visit our "contact page"
e) We cannot be held responsible for inaccurate product choice; we have technical advice available. Advise & guides cannot be confirmation of your leather type, colour, problem or otherwise as a physical inspection must be given to give confirmation information before product selection or to advise against product selection.
f) Buffalo Leather repair products are intended to improve or maintain the appearance of damaged, worn, and aged leather surfaces. The application of products is dependent on the skill of the user & we cannot guarantee your skill of application to achieve the desired effect you require. We cannot be held responsible for the misuse or incorrect application of repair & care products. We cannot guarantee the longevity of the repair & care products once applied to the leather surface, as this is dependent on the previous care routine, ongoing maintenance of the leather, contamination that may occur from within or on the leather, and abuse the leather surface may receive from humans & animals or otherwise.
g) You as the purchaser agree to test the products for compatibility or reaction before full application. In the event of a reaction you agree that you will not proceed to apply the product to the surface of your item.
h) Water Based Products are to be used within 12 months of purchase, after 12 months the formulation will not perform to the standard it has been sold.
i) Solvent Based Products are to be used within 1 month of purchase due to evaporation, after 12 months the formulation will not perform to the standard it has been sold.
 

(5) Price and payment
Prices for products are quoted on our website. The website contains a large number of products and it is always possible that some of the prices on the website may be incorrect. We will verify prices as part of our sale procedures so that a product's correct price will be stated when you order or pay for the product.
In addition to the price of the products, you may have to pay a delivery charge, which will be as stated when you order or pay for the product.
Payment must be made upon the submission of your order. We may withhold the products and/or cancel the contract between us if the price is not received from you in full in cleared funds.
The prices on the website include all value added taxes where applicable.
Payment for all products must be made by online secure credit card facilities or by PayPal. Payments can also be processed over the telephone by debit/credit cards by contacting: 01772 611449.
Prices for products are liable to change at any time, but changes will not affect contracts which have come into force.

(6) Your warranties
You warrant to us that:
(a) You are legally capable of entering into binding contracts, and you have full authority, power and capacity to agree to these terms of sale;
(b) The information provided in your order is accurate and complete;
(c) You will be able to accept delivery of the products;
(d) You are resident in the United Kingdom

(7) UK Delivery policy
(a) We will arrange for the products to be delivered to the address indicated in your order.
(b) We will use reasonable endeavors to deliver products by the date set out in our order confirmation or, however, we cannot guarantee delivery by any relevant date. We do however guarantee that unless there are exceptional circumstances all deliveries of products will be dispatched and reach you within 30 days of the dispatch date confirmation.
(c) We ensure goods dispatched are protected and in good condition, if the courier or postal service damage these goods during transit we will not be held responsible for reimbursements to rectify damage caused by leakages to your premises or personal possessions, reimbursements will be pursued to the delivery company who caused the damage. We will only refund for the damaged item purchased. 
(d) Goods must be checked when they arrive at your delivery address to ensure the order is complete and free of damages, we must be informed of any discrepencies in regards to your order within 48hrs of goods arriving, after 48hrs your goods will be deemed as arriving complete and in good condition.

If goods cannot be received to the delivery address provided by the customer, and goods are returned to Buffalo Leather Repair and Care Limited, it is the responsibility of the customer to arrange payment for re-delivery of the order at a cost of £5 or greater depending on the weight of the items purchased.
Buffalo does not charge a profit on postal & packaging charges and remain fair regarding these delivery costs.
 
(8) Risk and ownership
The products will be at your risk from the time of delivery. Ownership of the products will only pass to you upon the later of:
(a) Delivery of the products; and
(b) Receipt by us of full payment of all sums due in respect of the products (including delivery charges).
We will be entitled to recover payment for the products even where ownership has not passed to you.

(9) "Cooling off" period
a) You may cancel a contract to purchase a product or products at any time within 14 working days after the day you received the relevant products or products (subject to the limitations set out below).
b) You will not have any such right insofar as a contract if it relates to: (1) the supply of goods made to your specifications or clearly personalised; or (2) the supply of goods which by reason of their nature cannot be returned due to being used and in an un-saleable condition, or are liable to deteriorate or expire rapidly.
c) If you cancel a contract outside the limitations, you must inform us in writing and return the products to us immediately, in the same condition in which you received them. Products returned by you in accordance within section (a) will be refunded in full (including the cost of sending the products to you).
If you cancel a contract on this basis and you do not return to the products to us, we may recover the products and charge you for the costs we incur in doing so. Similarly, if you return the products at our expense, we may pass that expense on to you.

(10) Statutory rights
Nothing in these terms of sale affects your statutory rights (including your right to receive a refund in respect of any defective product we sell to you).

(11) Refunds, Returns, Faulty Goods
a) If you cancel an order before it is dispatched and are entitled to a refund, we will usually refund any money using the same payment method originally used to pay for your purchase. We will process the refund due to you as soon as possible within 30 days of the day we received your valid notice of cancellation.
b) If you the consumer returns an item because you have changed your mind or the product isn't suitable for your needs, we will refund for the product price only, we do not refund the original delivery cost. It is the responsibility of the buyer to arrange and pay the cost of return postage. (the item must be un-used and in a re-sale condition)
c) If an item fails to arrive, a duration of 30 days is applicable for the item to be sourced and forwarded to the customer, or returned to our depot before a customer refund can be issued should the goods no longer be required.

(11a) Receive Policy
Should you have any discrepancy with your order please notify us within 3 days.
If we do not receive any notice of discrepancy within this timescale your goods will be deemed as:
  • Arrived in a usable condition
  • Deemed fit for use
  • Your goods are complete

(12) Liability
The purchaser will agree that Buffalo Leather Repair and Care Ltd will not be held liable for : (1) death or personal injury caused by negligence; (2) fraud or fraudulent misrepresentation; or (3) Damage to leather or fabric items caused by mis-application of products or by tanning or finishing problems within or on the leather surface.
Subject to this, the products we sell are intended for personal use only and the purchaser will not not hold Buffalo Leather Repair and Care Ltd liable for any business losses (including without limitation loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data or waste of management or office time.

(13) General terms

Images of products on our website are for illustrative purposes; actual products may differ from such images.

We will treat all your personal information that we collect in connection with your order in accordance with the terms of our privacy policy; use of our website will be subject to our website terms of use.

Contracts under these terms of sale may only be varied by an instrument in writing signed by both you and us. We may revise these terms of sale from time-to-time, but such revisions will not affect the terms of any contracts which we have entered into with you.

If any provision of these terms of sale is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect, and such invalid or unenforceable provisions or portion thereof will be deemed omitted.

No waiver of any provision of these terms of sale, whether by conduct or otherwise, in any one or more instances, will be deemed to be, or be construed as, a further or continuing waiver of that provision or any other provision of these terms of sale.

You may not assign, charge, sub-contract or otherwise transfer any of your rights or obligations arising under these terms of sale. Any attempt by you to do so will be null and void. We may assign, charge, sub-contract or otherwise transfer any of our rights or obligations arising under these terms of sale, at any time - providing such action does not serve to reduce the guarantees benefiting you under these terms of sale.

Each contract under these terms of sale is made for the benefit of the parties to it and is not intended to benefit, or be enforceable by, any other person. The right of the parties to terminate, rescind, or agree any amendment, variation, waiver or settlement under such contracts is not subject to the consent of any person who is not a party to the relevant contract.

Subject to the first paragraph of Section [12]: these terms of sale contain the entire agreement and understanding of the parties in relation to the purchase of products from our website, and supersede all previous agreements and understandings between the parties in relation to the purchase of products from our website; and each party acknowledges that no representations not expressly contained in these terms of sale have been made by or on behalf of the other party in relation to the purchase of products from our website.

These terms of sale will be governed by and construed in accordance with English law, and the courts of England and Wales will have non-exclusive jurisdiction to adjudicate any dispute arising under or in relation to these terms of sale.

(14) Packaging
The packaging illustrated on our product description images may differ to what you receive, this is because we may need to change our packaging if our current packaging is not available from our suppliers, or if we decide to update our designs/ packaging.
